Which interpretation is correct? The NWPC person explained to me that if say an employee is absent for 5 days during the year, then the number of days worked is 288-5 (assuming one worked 6 days a week = 288 days). Therefore, 283 days will become the basis for the computation of the 13th month pay, not 288. The computation, according to the person is "pro-rated."

However, as quoted from a comment in this blog, which reads: "In G.R. 145561 (dated 15 June 2005), the SC ruled out: "For employees receiving regular wage, we have interpreted “basic salary” to mean, not the amount actually received by an employee, but 1/12 of their standard monthly wage multiplied by their length of service within a given calendar year". So, it is clear from that ruling that lates and absences shall not be deducted from the basic salary in order to compute 13th month pay."

Do I take this to mean the SC ruling in the Honda case applies to ALL companies giving 13th month pay to their employees? That ALL employers CANNOT deduct absences and late attendance from the final computation of the 13th month pay?

Re: How to compute 13th Month Pay: DOLE Philippines

pano po computation ng 13th month pay if hired lang po last september? thanks.

Re: How to compute 13th Month Pay: DOLE Philippines

unused vacation and sick leave credits, overtime, premium, nigh differential and holiday pay, and cost-of-living allowances.- meaning these are included in the basic pay? as stated by law???

Re: How to compute 13th Month Pay: DOLE Philippines

The 13th Month Pay is required by law and will be entitled to every employee working in the Philippines, with the computation of the 13th Month Pay equivalent to the number of months the employee has worked.

Re: How to compute 13th Month Pay: DOLE Philippines

In the Philippines, Dole has introduced premium quality, healthy food products.
