There, the stipulations are stated (e.g., fee, terms, tax, etc). Assuming you are renting for business purposes, you, as a lessee is required by BIR to withhold (5%) witholding tax on income payments from rental fee. You are right in saying that the lessor is the one who earns income, and the one who is liable to BIR an income tax. That's why the BIR requires lessee to deduct a 5% withholding tax on monthly rent income that you will pay to the lessor. To make this clear, let us say for example, your gross monthly rent is 20,000. You should withhold 5% of it (1,000) and remit monthly to BIR using BIR form 1601E as discussed in my previous answers on the previous questions. Thus, you will only pay the lessor an amount of P19,000, which is net of 1,000 withholding tax (remitted to BIR). The lessor, in return will ask you for the certificate of withholing tax, which he will use to claim against his Income tax when he file and pay it to the BIR.

I just don't know what is the reason of the additional 1,000 your lessor is charging you every month. It can be an allowance to cover the tax that will be incurred by the lessor. Or it can be another allowance which can be returned to you after a period of time. I would recommend reading and examining your contract of lease with your lessor to determine the clear stipulations stated in there, and find out if they are fair and square.

Re: How to compute percentage tax in the Philippines

Hello, hope you can help me answer this tax question.I am renting a space in paranaque for 20k/month.The buildong owner said to pay her total of 21k for tax and she will refund it to me after 12 months. In my understanding, she will refund me total of 12k at the end of the year.Question is, what is that tax fee for?should it be the lessor should pay the tax since that rental is really her income?pls reply.thanks.

Re: What is Viral Marketing?

It is something that spreads through word of mouth almost infectiously like a virus where if one person sees it, instantly that person transfers it to someone else.

Re: Viral Marketing and the Word of Mouse

wow is nice and good information in ur blog my friends.....

Re: Philippines’ Top 25 Blogs of 2009

Nice list. The basic rule in determining compensation is: NO WORK, NO PAY. During suspension, you are not rendering any services and is not paid for any work done. Therefore, that one month period is excluded.

Re: How to compute 13th Month Pay: DOLE Philippines

Rachelle,

You may want to read our article on "Philippine Laws for Women at Work."
http://businessaccent.com/2009/11/16/philippine...

Re: Overtime pay laws and computation in the Philippines

anna said: "if this is the case, in terms of their pay, these 2 employees are not considered "managerial employees" as defined by DOLE because they receive holiday pay and OT."

the fact that they are given OT pay or other benefits normally for other types of employees, does not matter - what is important is the nature of their functions.

"managerial employees" are not always called "managers," they can be designated in many names but what makes them managerial is the kind of work they perform in the establishment.

Managerial employees, as defined by law are those:
1)	whose primary duty consists of the management of the establishment in which they are employed or of a department or subdivision thereof; [they formulate policies]
2)	who customarily and regularly direct the work of two or more employees therein; [they execute management policies]
3)	who have the authority to hire and fire employees of lower rank, or their suggestions and recommendations to hiring and firing and as to the promotion or any other change of status of other employees, are given particular weight. [they can impose disciplinary actions]

Your office staff may fall under any of these categories.

anna said: "i am just confused with their classification and therefore what factors to use."

Whether your office staff is monthly paid or daily paid will depend on your company policy or what is stipulated in their employment contracts.

Managerial employees are not covered by the Labor Code provisions on hours of work, holidays, overtime, etc. (Book III, Title I, Labor COde). This is because the nature of their work and the skills, knowledge or expertise they use justly requires higher rates of compensation.

Assuming you consider your managerial employees as monthly paid (which is usual for high-paying jobs), Monthly paid are those paid every day of the month including unworked rest days, special days and regular holidays. BUT NOTE of the words UNWORKED REST DAYS and HOLIDAYS. This does not include UNWORKED WORKING DAYS.

The basic principle governing compensation in the Philippines is "NO WORK NO PAY." Thus, if they are absent on any WORKING day, then they should not be paid. This is based on the 2004 Supreme Court case of Odango vs. NLRC which says that the principle of "no work, no pay also applies to monthly-paid employees. Otherwise, it would be unfair for the employer to be paying for something which the employee did not work for.

Re: How to register thy business in the Philippines

If you do not want to have 5 directors you can open a partnership in the Philippines. That's right, submitting to article directories like EzineArticles, is one best way to gain traffic. Actually I do that. It's not only giving you traffic but also increases your backlinks. But as I said, quality first. Meaning, you need to submit quality articles - so it will be loved by whoever it will read. That's the beginning of traffic and popularity.

Re: 6 tips to skyrocket your blog traffic

Hi RTF,

Thank you for the visit. And thanks a lot for sharing your additional insights. Just as I said quality first. In my blogging experience Google is my no.1 top referrer of visitors, next is stumbleupon. The key to success in social network like Stumble and Twitter lies on what you share on the community. I have some articles that were stumbled, they are giving me thousands of visitors every month. People will stay reading at your page to read your particular content when they are made at best. This is the reason why I don't share all of my articles to social sites. I only select the best.

BTW, your content in stumble, relies on the visitors who will click that "like" button in their stumbleupon toolbar. The more people will like it, the more visitors will coming to your blog. So - quality of the content is the key to that.

Re: Business care and precaution

I think these businesses need our help. Traffic is traffic, no matter where they came from, it is still traffic, and we long for it in our blog. The problem with social networks to drive traffic to your site is the bounce rate. I tried many of the social networks you mentioned but I think it's a waste of time. If you stop doing it, traffic won't come, and if you are engaging with it, traffic will come but sadly with high bounce rate. Digg and stumble upon traffic landed to your site only in a few seconds and most do not bother to look at your other pages. The most unfortunate thing is that they don't convert. Twitter is better in conversion than any other social network I've known, at least in my own experience. If you promote some product, tweeters are buying it like crazy, but its all number games, the more the followers, the higher the sales.

SEO is the best, nothing will beat it. Good content and right keywords are the driving forces for a better revenue. All are my personal view based on my experience, so no big deal.

Re: How to compute 13th Month Pay: DOLE Philippines

Hi!
